These conditions govern access to Tucker County Criminal History. Viewing its material or submitting a query means that you agree to them. Anyone who does not agree should discontinue use of the site.

NO FCRA USE. Tucker County Criminal History is privately operated and has no connection to a local, West Virginia, or federal government body. It and its advertising partners do not provide services for any purpose regulated by the Fair Credit Reporting Act (FCRA), including credit, employment, insurance, or tenant-screening decisions. The site identifies criminal-record resources in Tucker County and West Virginia. It is neither a private investigation business nor a consumer reporting agency.

1. What This Website Is

This private reference site is independent of government. It does not keep official records, submit filings, retrieve documents, or perform an official background check.

Its function is to direct readers to the Tucker County Sheriff, Magistrate and Circuit Courts, the West Virginia State Police Criminal Identification Bureau, the West Virginia State Police Sex Offender Registry, and outside tools that may assist personal research.

2. Rules for Using This Site

Users must not:

  • Use the site in violation of local, state, or federal law
  • Harass, threaten, stalk, or intimidate anyone with information found here
  • Rely on site content for housing, hiring, credit, or insurance decisions
  • Attempt unauthorized access to any account, server, or system
  • Operate scrapers, bots, or automated collection tools against the pages
  • Interfere with performance or prevent another visitor from using the service

3. No Harassment, Stalking, or Discrimination

No site or linked-tool information may be used to harass, stalk, intimidate, threaten, or unlawfully discriminate. The West Virginia State Police Sex Offender Registry expressly warns against threats, intimidation, and harassment. Knowingly using registry data to commit a criminal act may be prosecuted. Registry access supports lawful public-safety awareness, never retaliation or vigilante conduct.

4. We Are Not a Consumer Reporting Agency

Tucker County Criminal History is not a consumer reporting agency under the FCRA and produces no credit report, consumer report, or official background check. Its data and linked tools may not be used to:

  • Make an employment decision
  • Evaluate a tenant or housing applicant
  • Set insurance terms or assess creditworthiness
  • Decide eligibility for a permit, license, or public program
  • Carry out any other FCRA-regulated purpose

A legally required official check must use the authorized West Virginia State Police Criminal Identification Bureau process or an appropriate FCRA-compliant provider.

5. No Legal Advice

Site content is general information, not legal advice. Only a licensed West Virginia attorney can advise how a Tucker County charge, warrant, conviction, or expungement law affects a particular situation.

6. No Warranties

All material is offered "as is," without a promise that:

  • Information will always be complete, correct, or current
  • Access will remain continuous or uninterrupted
  • Every page will be free from defects, errors, or security weaknesses
  • An outside search provider will return accurate or comprehensive results

Criminal records change as charges are filed, resolved, sealed, or expunged. Updates can lag, and omissions can occur. Site content is never an official statement from the Tucker County Sheriff, a court, or a West Virginia agency.

7. Third-Party Services and Links

Links may lead to government offices, courts, legal resources, or outside search providers. Those destinations are beyond our control. Their availability, content, charges, data practices, and accuracy are their responsibility, so review their terms before use.

8. Intellectual Property

Text, graphics, logos, and code belong to Tucker County Criminal History or its content partners. Copying, distribution, modification, or derivative use requires prior written permission.

9. Limits on Our Liability

To the maximum extent allowed by law, we are not responsible for damages arising from site use or reliance on information supplied here or by a linked service.

10. Indemnification

A user agrees to indemnify and hold us harmless from claims, demands, or proceedings caused by that user's conduct or breach of these terms, including related legal costs.

11. Governing Law

West Virginia law governs these terms. Any dispute arising from site use must be brought in a court with proper jurisdiction in West Virginia. Official record access remains governed by laws such as the West Virginia Freedom of Information Act and the criminal-history dissemination limits in W. Va. Code §15-2-24.

12. Changes to These Terms

These terms may be revised. A new version becomes effective when it is posted here.

13. Cutting Off Access

Access may be restricted or ended at any time, with or without advance notice.

14. Severability

If one provision is held invalid or unenforceable, the remaining provisions continue in force. The affected language will be narrowed only as needed to make it enforceable.
